MINIMUM LENGTH VARIATION ORDER 2008-067
The Regional Director General, Gulf Region, Department of Fisheries and Oceans, pursuant to paragraph 43(m) of the Fisheries Act and subsection 6 (1) of the Fishery (General) Regulations, hereby makes the annexed Order varying the minimum length for herring in Herring Fishing Areas 16A to 16G.

ORDER VARYING THE MINIMUM LENGTH
FOR HERRING IN HERRING FISHING AREAS 16A TO 16G
Short Title
1. This Order may be cited as the Gulf Region Minimum Length Variation Order 2008-067.
Variation
2. The minimum length as fixed by subsection 44(1) of the Atlantic Fishery Regulations, 1985 is hereby varied so that no person shall fish for, buy, sell or have in his possession any herring that is less than 23.5cm in length in Herring Fishing Areas 16A to 16G (inclusive).
3. Subsection 44(2) of the Atlantic Fishery Regulations, 1985 is hereby varied so that no person in Herring Fishing Areas 16A to 16G (inclusive) shall incidentally catch and retain herring less than 23.5cm in length of an amount greater than 10 per cent of the longer herring that was caught and retained during that fishing trip.
Coming Into force
 
4. This Order shall come into force on July 1 and remains in force until December 31, 2008, at which time the minimum length shall revert to the one set out in the said regulations.

PURSUANT TO THE FISHERY (GENERAL) REGULATIONS AND BY THE GULF REGION MINIMUM LENGTH VARIATION ORDER 2008-067, THE MINIMUM LENGTH FOR HERRING IN HERRING FISHING AREAS 16A TO 16G (INCLUSIVE) IS VARIED TO 23.5CM AND NOT MORE THAN 10 PER CENT OF HERRING CAUGHT AND RETAINED CAN BE LESS THAN 23.5CM IN LENGTH IN THESE AREAS.
THIS VARIATION ORDER DOES NOT APPLY TO THE HERRING GILL NET FISHERY IN THESE AREAS.
