SIZE LIMIT VARIATION ORDER, 2011-034

The Regional Director General, Gulf Region, Department of Fisheries and Oceans, pursuant to paragraph 43(m) of the Fisheries Act and subsection 6(1) of the Fishery (General) Regulations, hereby makes the annexed Order varying the close time and size limit for fishing for scallop in Scallop Fishing Area 22.

ORDER VARYING THE CLOSE TIME
AND SIZE LIMIT FOR FISHING FOR SCALLOP IN
SCALLOP FISHING AREA 22.

Short Title

1. This Order may be cited as Gulf Region Close Time and Size Limit Variation Order 2011-034.

Variation

2. Gulf Region Close Time Variation Order 2011-029, is hereby revoked.

3. The close time as fixed by subsection 63(1) of the Atlantic Fishery Regulations, 1985 and set out in subitem 22(j) of Schedule XVI, thereto, is hereby varied so that no person shall fish for scallop in a Scallop Fishing Area referred to in Column I from a vessel of a class set out in Column II during the close time set out in Column III of Schedule XVI of this Order.

4. The size limit as fixed by paragraph 64(1) (c) of the Atlantic Fishery Regulations, 1985 is hereby varied so that no person shall catch and retain or have on board a vessel any scallops, the number of meats of which exceeds an average count of 44 meats per 500g, if the scallops were caught in Scallop Fishing Area 22.

Coming Into Force

5. This Order shall come into force on the date of signature and remains in force until December 31, 2011, at which time the close time shall revert to that which is set out in Schedule XVI of the said Regulations.

NOTICE

The Regional Director General for the Gulf Region, Department of Fisheries and Oceans, hereby gives notice that the season and size limit for scallop in Scallop Fishing Area 22 will be as follows:

Scallop Fishing Area 22

Will be open from 06:00 hrs May 2 to 18:00 hrs June 6, 2011. Fishing will only be permitted between 06:00 hrs to 18:00 hrs every day, except Sundays when the fishery will be closed.

Maximum average scallop meat count permitted is 44 scallop meats per 500 grams.

Fishing for scallop in Scallop Fishing Area 22 is prohibited within a 6-fathom buffer zone in waters adjacent to the Provinces of New Brunswick and Prince Edward Island.

FISHING WILL ONLY BE PERMITTED BETWEEN 06:00 HRS TO 18:00 HRS EVERY DAY, EXCEPT SUNDAYS WHEN THE FISHERY WILL BE CLOSED. FISHING FOR SCALLOP IN SCALLOP FISHING AREA 22 IS PROHIBITED WITHIN A 6-FATHOM BUFFER ZONE IN WATERS ADJACENT TO THE PROVINCES OF NEW BRUNSWICK AND PRINCE EDWARD ISLAND.

NO PERSON SHALL, IN SCALLOP FISHING AREA 22, CATCH AND RETAIN, OR HAVE ON BOARD A VESSEL, ANY SCALLOP, THE NUMBER OF MEATS OF WHICH EXCEEDS AN AVERAGE COUNT OF 44 MEATS PER 500g.
