CONTAMINATED FISHERIES
PROHIBITION ORDER NO. GSN-2010-026

WHEREAS the Regional Director General of the Department of Fisheries and Oceans for the Gulf Region has reason to believe that fish of the species set out in section 2 of the annexed Order, in the area described in the schedule to that Order, are contaminated;

THEREFORE, the Regional Director General for the Department of Fisheries and Oceans for the Gulf Region pursuant to subsection 3(1) of the Management of Contaminated Fisheries Regulations, made by Order in Council P.C. 1990-1121 of June 14, 1990*, hereby revokes Contaminated Fisheries Prohibition Orders No. GSN-2000-007 issued on February 11, 2000, GSN-2001-016 issued on June 4, 2001, and GSN-2007-013 issued on April 4, 2007, and issues the annexed Order prohibiting fishing for contaminated fish.

ORDER PROHIBITING FISHING FOR CONTAMINATED FISH

Short Title

1. This Order may be cited as the Contaminated Fisheries Prohibition Order No. GSN-2010-026.

Prohibition

2. Subject to subsection 3(2) of the Management of Contaminated Fisheries Regulations, no person shall, in the areas described in the schedule, fish for bivalve molluscs including bay scallops.


Coming into Force

3. This Order shall come into force on the date of signature and remains in force unless otherwise revoked.

The following areas within or adjacent to Kings County, Prince Edward Island:

1. St. Peters Bay inside a line drawn from grid reference 521650 5141650 seaward to grid reference 521530 5142000, thence to grid reference 522380 5142270 and thence shoreward to grid reference 522450 5141780 (Refer to map Mount Stewart 11L/7; North American Datum 1927);

2. Morell River inside a line drawn from grid reference 523930 5141000 to grid reference 524860 5141260 (Refer to map Mount Stewart 11L/7; North American Datum 1927);

3. St. Peters Bay and Midgell River inside a line drawn from grid reference 528550 5140370 to grid reference 528920 5140300 (Refer to map Mount Stewart 11L/7; North American Datum 1927);

4. St. Peters Bay inside a line drawn from grid reference 531150 5140970 to grid reference 530930 5140150 (Refer to map Mount Stewart 11L/7; North American Datum 1927);

5. North Lake inside a line drawn from grid reference 571420 5146330 to grid reference 571450 5146310 (Refer to map Souris 11L/8 & 11K/5; North American Datum 1927);

6. Colville Bay bounded by the shoreline and a line drawn from grid reference 556580 5133725 to grid reference 557400 5131870 and thence to grid reference 558400 5132150 (Refer to Map Souris 11L/8 & 11K/5; North American Datum 1927);

7. Fortune River inside a line drawn from grid reference 548800 5131490 to grid reference 548700 5131550 (Refer to map Souris 11L/8 & 11K/5; North American Datum 1927);

8. That portion of Boughton River inside a line drawn from grid reference 539490 5123990 on Poplar Point to grid reference 539450 5123510 on Chapel Point and all tributaries to that portion of the river (Refer to map Souris 11L/8 & 11K/5; North American Datum 1927);

The waters of Georgetown Harbour from a line drawn from grid reference 535736 5113725 at the end of the wharf at Gaudin Point then southeast to grid reference 536484 5112527 then eastward to grid reference 536752 5112520 then northeast to a point on land at the east end of Poxy Island at grid reference 537389 5113142.(Refer to map Montague 11L/2; North American Datum 1927);

10. The foreshore and waters of Brudenell River within a 125 m radius of grid reference 532200 5116100 (Refer to map Montague 11L/2; North American Datum 1927);

11. Waters of Cardigan River (Byrnes Creek) inside a line drawn from grid reference 531300 5119575 to grid reference 531520 5119400 (Refer to map Montague 11L/2; North American Datum 1927);

12. Flat River inside a line drawn from grid reference 509600 5094430 to grid reference 509600 5094640 (Refer to map Montague 11L/2; North American Datum 1927);

13. Murray Harbour and South River inside a line drawn from grid reference 537830 5095990 on Machons Point to grid reference 540321 5096384 on Beach Point (Refer to maps Boughton Island 11L/1 and Montague 11L/2; North American Datum 1927);

14. The waters of Murray River upstream of a straight line drawn from grid reference 532380 5096580 to grid reference 532380 5096152 (Refer to map Montague 11L/2; North American Datum 1927);

15. The waters of Little Basin inside a line drawn at the bridge from grid reference 536394 5100342 to 536428 5100342 (Refer to map Montague 11L/2; North American Datum 1983).

Note: When the boundary of an area is expressed in grid references, those grid references are based on the Universal Transverse Mercator Grid system set out on the National Topographic Series Map, Scale 1:50,000 published by the Department of Energy, Mines and Resources (North American Datum 1927 & 1983).


NOTICE

The Regional Director General for the Gulf Region, Department of Fisheries and Oceans, hereby gives notice of the following changes in the areas described in the Schedule of the Contaminated Fisheries Prohibition Order No. GSN-2010-026 while fishing of any bivalve molluscs including bay scallops in the Province of Prince Edward Island:

Note:

The following area is now open:
• The foreshore and waters off Northumberland Provincial Park within a radius of 125 m of grid reference 522090 5089790 (Refer to map Pictou Island 11E/15; North American Datum 1927).

The following area is an additional closure:
• The waters of Little Basin inside a line drawn at the bridge from grid reference 536394 5100342 to 536428 5100342 (Refer to map Montague 11L/2; North American Datum 1983).

Please note that Murray Harbour and South River as well as the waters of Murray River remain closed.

Note : When the boundary of an area is expressed in grid references, those grid references are based on the Universal Transverse Mercator Grid System set out in the National Topographic Series Map, Scale 1:50,000 published by the Department of Energy, Mines and Resources (North American Datum 1927 & 1983) .

Contaminated Fisheries Prohibition Order No. GSN-2010-026 will come into force June 30, 2010 and remains in force unless otherwise revoked.
